Lending on inventory that is in transit poses a host of issues that for some constitutes uncharted territory. Given the location of the inventory outside the U.S. and the many players who facilitate movement of the inventory, a lender faces issues regarding the scope of its lien, the rights of unpaid sellers, and the claims of third parties involved in the shipping process. Good legal advice requires an understanding of these risks and the relative benefits and detriments of certain shipping documents and tri-party agreements. This program will assist anyone attempting to navigate these issues.
